Why Union Has No Jail

The New Mexico Counties detention report identifies Union among counties without an adult jail. The current intergovernmental agreement between Colfax and Union fills part of that gap. Colfax County owns and operates Vigil-Maldonado Detention Center in Raton and may accept qualifying Union detainees when bed space and agreement terms permit.

This arrangement prevents a simple Clayton jail-roster lookup. The Union County Sheriff may be the arresting or transporting agency, while VMDC keeps the intake, physical custody, and release chronology. Union County courts hold the orders that authorize bond, dismissal, sentence, probation, or another outcome. The county name can describe the arrest, court, residence, or prison location without naming the actual jailkeeper.

Where Union Release Records Begin

Vigil-Maldonado Detention Center is the primary documented adult detention path for qualifying Union County detainees. The agreement is space dependent, so no one should assume that every local arrest produces a VMDC booking. Ask the Union County Sheriff or the court which facility received the person. That first classification avoids searching the wrong county or mistaking a failed roster search for release.

Northeast New Mexico Correctional Facility creates a separate point of confusion. It is physically located near Clayton, but it is an NMCD state prison. It houses state-sentenced prisoners and does not serve as the ordinary Union County pretrial jail merely because it stands within county lines. Its releases are tracked through NMCD's offender, sentence, supervision, and discharge systems.

Note: Confirm the actual receiving facility before treating a failed Union County search as evidence that custody ended.

Confirm a Union Jail Release

Start with custody, not with assumptions about geography. If the person was booked at VMDC, call 575-445-3691 and ask whether the facility currently holds the person. When it does not, ask whether an existing record shows the date, release disposition, and destination. Staff may require a written request for detail. A court order explains authority, while the jail record confirms physical execution.

1. Contact the Union County Sheriff with the full name, approximate arrest date, and case number to identify the transport or receiving facility.
2. Contact that facility and distinguish current custody from a past release or transfer.
3. Request the release date, time, coded type, and receiving destination from the physical jailkeeper.
4. Match the entry to New Mexico Courts Public Case Lookup and the correct Clayton court.
5. Trace any transfer through NMCD, BOP, ICE, another county, or the receiving agency named in the record.

A person can disappear from one agency's view because of a transfer, name variation, data issue, or normal live-roster removal. None proves community release on its own. The event and destination must agree.

Match more than a common name. A date of birth, booking or offender number, approximate dates, case number, and arresting agency can separate two people with similar identities. If dates conflict, retain their labels. A judge can sign an order, VMDC can process it later, and a court or supervision database can update after both events. Collapsing those timestamps into one date can create a false correction request.

Union Sheriff Release Contacts

The Union County Sheriff page provides the local law-enforcement contact. It does not advertise an adult jail, inmate roster, recent-release list, photo gallery, or detention mobile app. Sheriff Curtis Skaggs and the office can address the arrest or transport record the agency created, but VMDC remains the custodian of its own physical booking and release chronology.

Use that office for Union arrest and transport records, then direct the physical custody question to the facility it identifies.

Union Court Release Orders

The Union County District Court and Clayton Magistrate Court share 100 Court Street, Suite 5, in Clayton. Their roles differ. Magistrate records can show misdemeanor, DWI, traffic, preliminary felony proceedings, and bond. District records preserve felony disposition, judgment, and sentence. The Eighth Judicial District contact page lists the two offices and their separate telephone numbers.

A signed bond or release order does not alone prove the time VMDC completed processing. Compare the order with the final jail entry. Different order, processing, data-feed, and supervision dates can all be accurate labels for different stages.

Note: The court documents release authority, but the physical jailkeeper records when custody actually ended or transferred.

Request Union Release Records

Send the records request to the agency that created the requested part. VMDC should receive a request for its booking and release chronology. Union Sheriff should receive a request for its arrest, transport, or separate image record. The filing court should receive a request for the judgment, bond or release order, dismissal, probation order, or filed discharge.

New Mexico IPRA requests should describe existing records with reasonable particularity. For a VMDC event, identify the full name, date of birth if known, booking number, Union arresting agency, and date range. Ask for the existing final release entry, date and time, disposition, bond or order authority, destination or receiving agency, and releasable booking photograph. This phrasing seeks records and does not demand that staff create a new answer.

Under Section 14-2-9, an agency can redact protected content and produce nonexempt portions. The law does not mean that every correctional field must be public. Juvenile, medical, victim, witness, sealed, and expunged material may require limits.

A booking photograph follows the same custodian split. VMDC may maintain the intake image it created, while the Union Sheriff may hold a separate arrest image. No official current public photo feed was found for either office. Identify the exact event in a request and ask for any releasable photograph, allowing the custodian to apply redaction and access law. A missing photo online does not show that no image was taken.

Use the Judiciary IPRA portal for court documents and direct the request to the specific Union court. A court file can outlast a short detention stay and may preserve the bond, dismissal, sentence, probation, or revocation that explains the legal outcome. It does not usually certify the exact time a jail completed physical release processing.

Custodian

The office that created or maintains the requested record.

Release disposition

The recorded type or reason that ended one facility's custody.

Transfer

A move to another custodian rather than community release.

Expungement

A court process that can restrict access to qualifying criminal records.

Why Union Releases Use Two Systems

Union County is unusual because it lacks an adult county jail while hosting a state prison. A local arrestee may travel to Raton for county detention. A state-sentenced NMCD prisoner may be housed near Clayton at NENMCF. Those people can both be described informally as “Union County inmates,” but their records, legal authority, and release routes differ.

For a VMDC detainee, seek the Colfax County jail record and the originating Union court case. For NENMCF, select “Include Inactive” in the NMCD offender search, verify with the institution or P&P office, and request a final state release record when needed. The Union Sheriff should not be asked to certify a state-prison discharge merely because NENMCF lies within the county.

The VMDC release page provides the detailed offsite detention path. Older Clayton prison records may use “Clayton Correctional Center,” but current NMCD material uses Northeast New Mexico Correctional Facility and state management.

Union Transfers to ICE

If a VMDC release entry names ICE, it records a transfer. Search ICE ODLS using the A-number and country of birth, or exact name and country of birth. ICE includes people released from its custody only during a 60-day window, so prompt checking matters. Later silence from the locator cannot resolve the outcome.

The ICE Detention Reporting and Information Line is 1-888-351-4024, open Monday through Friday from 8:00 a.m. to 8:00 p.m. Eastern with language help. Preserve the VMDC destination and date before the online window closes. For a federal criminal transfer, use the federal docket and BOP locator instead.

Each transfer should be followed to the next custodian. That chain is the core of a sound Union County released inmate search.
